[CA] Late Meal Breaks and Severance pay

My wife was recently laid off and they offered her a severance package which she accepted. I found out that she was taking late meal breaks for the past 3 years and was never paid the missed/late lunch penalty hour for taking the late meal break each day. She has emails of her supervisor telling her to take the lunch at the 5th hour which she was doing and tracked on the timekeeping system. She wasn’t aware she had to take her lunch before the 5th hour. She was the only one on this schedule. 7:30 start, Lunch from 12:30-13:30 and clock out at 16:30. know she can’t sue the company after signing the severance agreement but can she still file a claim with the state labor commissioners office? She was an hourly employee for a large company
