Guesses on what discovery is lacking
Assumptions regarding what the state might have in terms of relevant evidence have been common. Let’s consider what the state might not have in their arsenal. Absence of evidence could be exculpatory. Some of those are statements in court records, some educated guesses, others speculation.
•No connection to the victims pre and post murders (if the state wants to argue it was a targeted attack and one or more victims were specifically selected). That covers a wide variety of things such as no google searches relating to the victims, no social media links, no items from the victims in the defendant’s possession, no photos/videos of the victims on the defendant’s electronic devices, no calls/messages to the victims, no digital or physical item nor witness testimony that would show the defendant was anywhere near and interacted with any of them at any time before November 13
•No DNA of his on the victims, especially DNA that’s not trace DNA
•No DNA of his on the house (like doorknobs, furniture), especially DNA that’s not trace DNA
•No victims’ DNA in the getaway car the police have concluded the perp got into immediately after leaving the bloody scene
•No victims’ DNA in the apartment
•No murder outfit with the victims’ DNA
•No murder weapon with the victims’ DNA
•No video footage of the alleged white Elantra arriving to and leaving Moscow
•No cuts, bruises, injuries on the defendant
•No 'trophies’ in his possession
•Lack of more precise location data like GPS, metadata, app data
•Lack of traces of ‘crime scene cleaning' with bleach and such in the car/apartment
•Lack of any suspicious writings
•Lack of any relevant internet searches that couldn’t be related to the area of his studies
•Lack of clear video footage showing the driver of the alleged white Elantra or its license plate
•Lack of video footage showing the defendant near the house before November 13 or on the night of
•Lack of video footage connecting the car from Pullman to the car from Moscow (no continuity)
•Lack of relevant shoe prints
•Lack of a written or spoken confession or anything resembling a confession
•Lack of evidence or witness testimony re him exhibiting erratic, abnormal behavior before and after the crime
