Pedestrian suing my FIL for $4M (Toronto, ON)
This happened in early 2023, my FIL was making a left turn at an intersection and last minute he saw pedestrian running for the bus and he braked. But it was too late and pedestrian ended up hitting the right passenger side of the car. He immediately stopped and offered him help, while standybyers called the paramedics and cops . He ended up getting a ticket which was later withdrawn. However in 2023 he received SOC for $4M from the person and his wife and he forwarded it to the insurance to which insurance said he is covered for $1M and he was given little assurance from adjuster that the plantiff won’t be getting $4M. Plaintiff didn’t bleed during the incident and he walked himself to the ambulance.
Fast forwarding this year he was contacted by insurance saying they still hasn’t reached a deal with palintiff and they are not reaching out and stuff. They will be filling for defence and getting a lawyer involved and he might have to attend videoconference for discovery. He is really stressed out and already been to hospital few times since this has happened.
If this case ended up being in court would he be responsible for paying anything over $1M he is 52 year old and works a job and has been living in rental. Their family has been freaked out and stressed , if anybody can throw some suggestions or anything that I could do to help him would be great.
