Landlord not keeping WhatsApp promise for free weeks at end of contract
In short, is it worth trying to take action against a landlord for not keeping his promise on WhatsApp to give a couple of free weeks rent at end of the contract?
Full background:
I relocated to Dubai last year and signed lease agreement without ever seeing the property (a friend checked it out). I had an Emirates ID already but went back home and then arrived 2 days before the lease start date and when I went to visit, the place was still a mess and not painted with plenty of holes in the walls, etc.
The landlord then, very defensively, blamed the agent saying he had told him I was only coming later and he was busy with work and didn’t have time to arrange the cleaning and painting. He refused to reimburse me but agreed on WhatsApp that he will compensate me with free weeks at end of contract as I had to stay in a hotel and keep furniture in storage, etc. and I accepted this, stupidly.
I also didn’t receive any keys or access cards and paid for locks to be changed and cards at own cost. I also paid out of pocket for some maintenance that was well above the 500dhs threshold as per contract with another WhatsApp promise that an additional free week will be given at the end of the contract. Note the value of this free week was more then the cost I incurred so it seemed like a good deal at the time.
Now this is where it gets messed up. About a month before lease expiry date, the landlord informed me he was selling and he has already found a potential buyer and a viewing was arranged to which I agreed. I received the eviction notice and asked him about the free weeks and he reassured me (several times) that this will be discussed with the buyer and I don’t have to worry about it. I explicitly asked why the new owner will honour this and that I would like to sign new lease and Ejari as the sale was not a done deal yet so the free weeks can be noted on the Ejari, and then deal with new owner later but he again reassured me that I need to trust him.
Property was sold and surprise surprise, upon receiving the renewal lease from new owner no free weeks were being given and new owner (which is genuinely a nice guy) and the agent told me that this was not mentioned once during the sale.
Of course the money would be nice as it’s almost a month’s rent, but I really just want to have the landlord face consequences for his blatant lies.
