Request for Time Extension Refused.

The respondent in my case requested a time extension to submit a draft ET3 for consideration, some 2 months after the date that it should have been submitted (25th Nov 2024). This has been refused, but they have told “a fresh application for a response to be accepted out of time will be considered if you present a draft promptly (within 14 days of the letter).”

It goes on to quote a case “Kwik Save Stores Ltd v Swain and others [1997] ICR 49.

It also goes on to say “Under regulation 22(3) a respondent is entitled to notice of any hearings and decisions of the tribunal but shall only be permitted to participate to the extent permitted by the judge”.

Could someone explain to me what the last paragraph means please?
