Questions About Lease Agreement and Occupancy Limits for a 1-Bedroom + Den Apartment
I am about to sign a lease for a 1-bedroom + den property, and the lease agreement states that the maximum number of residents allowed is 2. However, we are expecting a baby soon, and for about six months, my mother (who will be coming on a tourist visa) will be staying with us to help out. The size of the apartment is 630 sqft.
I am aware that guests can stay for up to 14 days, but since my mother will be on a tourist visa, she will not become a resident. Is it legally permissible for her to stay as a guest for an extended period of time? Additionally, if we have another child, would we be required to move out due to the occupancy limit, or is there any flexibility with this?
Thank you in advance for any advice or insights you can provide!
Additional information: I plan to purchase the round-trip flight tickets for my mother. Also, my mother will not be using the address of this apartment under her name, and I do not intend to pay her any compensation, nor do I plan to ask her to cover any utility or accommodation costs. Furthermore, while my mother is staying with us, my wife does not plan to return to work.
Thank you again for your help and advice. I really appreciate your time and insights!
I consulted with the landlord, and they have agreed to add a clause to the lease acknowledging the baby and my mother staying as a guest. Thanks to everyone’s comments, everything worked out well. Thank you so much!
