Loki waiting for the fruit to awaken implies he has its unawakened powers. Does that mean Loki has the actual Gomu Gomu no Mi? Maybe that's what the Marines replaced the Nika fruit with because there's no difference before it's awakened?

This makes a lot of sense. Carmel finds out about the Fruit, informs World Gov. World Gov decide to produce a super pirate who can become an Emperor, secure Elbaph as territory, and steal the Nika Nika fruit and repalce it some other similarly obscenely OP fruit which the giants can't really distinguish, and Shanks makes off with the real fruit only to have it eaten by a hungry Luffy. Isntead of being upset and killing Luffy, thus losing the fruit once again (to Elbaph where the tree that grows that fruit must be located), he instead chooses to let Luffy live and then return to Elbaph. If Luffy died, he could just take the fruit again when he was more prepared, if not Luffy would have to come to Elbaph anyway so Shanks could kill him and then take the fruit then anyway.

Shanks didn’t steal the fruit from Elbaph, he stole it from a navy ship that Who’s Who was in charge of protecting.
